Case 4: Causing a Riot in a Penal Institution/Drug Offense PDF Print E-mail
My client was charged with possession with intent to distribute along with several other passengers in a vehicle. My client was not a local guy and while in jail awaiting the outcome of the drug charge he got into a fight. He claimed three other guys had jumped him. I was able to review the video from the jail where it showed three guys fighting my client, but there wasn’t an angle that showed how the fight started.

I filed a pre-trial immunity motion right before trial and claimed self-defense. It wasn’t quite a “Perry Mason” moment but right before the other inmates were to take the stand on the hearing they told the prosecutor the truth that they didn’t like my client and had planned to jump him. The prosecutor quickly dismissed the charges and my client walked away with probation on the drug charge.
