Officers were called out for a possible domestic dispute and then arrested my client for maintaining a disorderly house because some underage teenagers were drinking at her house. I advised my client to waive their right to a jury trial and have a bench trial because it was strictly a legal question. The officer testified that he had never been out to the house before and didn’t know my client prior to this incident.

I moved for a directed verdict at the close of the state’s case. Under Georgia case law to be convicted of this offense there had to be multiple occurrences and a showing it was a disruption of the neighborhood. The judge granted my motion and the charges were dismissed against my client.
