The client, a former marine, who had never been arrested before in his life was charged with battery against a girl he had been dating. The girl alleged that she tried to break up with him and he got mad and pushed her down causing a bruise on her elbow. The state offered into evidence pictures that showed her injuries.

My client adamantly denied the allegation and said he actually broke up with her the night before and when she came over the next day he denied her advances and said that they should just be friends. She ended up slepping in his bed while he slept on the couch and then she left early in the morning. Next thing he knew he was getting arrested for battery when officers came to his house.

Prior to trial, I subpoenaed my client’s phone records, which showed the girl calling him all through the night after the break up and the next morning to come over and talk. This corroborated his story. Despite this evidence the state refused to drop the charges. The jury found my client not guilty in less than thirty minutes.
